My wife is cheating on me she is staying in a hotel with our 6mn old son and the guy comes over every night. She has also been in a mental hospital before I think because she tried to kill herself and they gave her meds wich she should still be taking but isn't. Also, her parents or atleast her step mom is going to be on my side if this goes to court (I have been trying to save our marriage but the wife won't). Oh also, our son is on WIC and Medicad and I found out when she did all the paper work for it she didn't tell them anything about her trust fund wich has about 30,000 in it.

You need an attorney yesterday. You can request an emergency custody hearing, if you feel your child is in danger. Beyond that, if your wife and child live out of the house for just a few weeks, the "status quo" will be set....she will get custody. Call an attorney today!

What's the deal about the status quo??? My husband left us (6 month old) when we were moving out of our first house...we stayed with a mutual friend for 2 weeks but stayed away from each other. He would dissapear at times and barely saw her even then. Then, baby and I moved into new house which he refused to do just to be difficult. My name on loan, us on deed...community property state. He doesn't pay for squat and doesn't see her EVER. Is there a chance I could get his rights taken away? The only thing he's god for a big fat negative attitude. I could only hope your answer would be yes!!

"Is there a chance I could get his rights taken away?"

It's very difficult to have parental rights terminated. What it usually takes is the person has to want to terminate them, and you would have to be remarried, and your new husband would have to sign paperwork that he will be adopting the child.
