I left my husband about a year ago and he filed for a divorce. We have been back together for 6 months. I am not planning on staying things are getting bad again. It is a really long story but what I need to know is what kind of proof that we are living together do I need to have this divorce thrown out? He got evidence on me that I was living with another man and he got custody of our child. So I want all the evidence he had to be inadmisable in court when we go back. I just don't know where to start with the proof and stuff. I can't talk to my lawyer about this because everything I talk with him about he talks with my husbands lawyer about and in turn it gets back to my husband and I can't risk this getting back to him now. So if anyone has been there and could help me out that would be wonderful.
Have you considered getting a new lawyer? One that will be completely on your side?
So, you are trying to get the divorce thrown out, so that the original custody judgement is thrown out? Did I get that right? Or are you trying to get custody of your child? I know I seem slow but I want to make sure I understand you BEFORE I chime in on this.
Thanks I think I am just going to talk to my lawyer and just tell him I need some advise on the subject to know how to leagally protect myself since I never know from one day to the next if he is going to want me here be threatening to take my child and leave country with her.
Good luck. I think the only thing you can do is seek legal counsel. Are you sure you can trust your current attny? Have you tried going to Legal Aid of Western (or Eastern) Oklahoma?
