My ex and I were wed in 94. After ten years, we called it off. She was maxing out every single credit card and ruined my credit. Anyway, in 2004, we seperated. She just recently filed for a divorce in roughly may of 2007. We have lived separately from each other for 3 1/2 years and she has done fine to support herself. I gave her EVERYTHING that we had, including all of our brood mares and my stallion. All that I took was my van, my clothes, and my one horse. I had no place to go, I ended up living at a barn in my van. She recieves ss and has no job but has done perfectly fine supporting herself for almost 4 years on her own. She has filed to recieve spousal support. I will be moving out of state in the middle of August and the job that I was supposed to have fell through and I will be losing my current job in August. What I want to know is, can she get spousal support after supporting herself on her own for four years. Please help.

You're going to have to hear from others here, but she did not set a good precedent for herself.

I dont think so. She is trying to tell the courts that she has all these medical problems and that she is depressed from all of this and blah blah blah. She is trying to say that her only support is her ss at 800/month and that her bills, which are getting paid, is at about 1500/month. Try to figure out how that works. Yes, I do make more than she does, however, my bills, which I am still trying to catch up on from our marriage, eats up about 90 per cent of my income. When we got married, all bills were put into my name and she was responsible for paying them, what she failed to tell me each month is that we were behind and now, I get to play catch up. We went into get a temp order of maintence and it was ordered that I pay 250 a month, which I dont have in the first place, but the commisioner was mad that I was driving a newer vehicle and didnt believe me that the payments were enourmously high because of her screwing up my credit. Anyway, she forget to get all the paper work in for it and it was never actually and legally ORDERED. so now, we get to go in and do it all again. Only now, my financial situation is alot worse!

Well, it would only be fair then to give her half of that credit card debt. See how she likes those apples!

I would love to do that but when she filed, we both agreed that whatever bills were in our names would be our own. The problem is with all of the bills I actually have to pay, there is NO POSSIBLE way that I can pay spousal support. Here is the funny thing though...she wants ME to pay ALL of her back medical bills which is probably 30k!

You have two strong arguments to make against spousal support:
1/ She has demonstrated that she can get by without it. Spousal support is supposed to be need based. She doesn't need it.
2/ You cannot afford to pay it.
In a reasonable world, you would prevail. Sometimes things get a bit unreasonable in court. Having a lawyer to help you can take some of the risk and uncertainty out of it for you.

If she asks for spousal support ask her for half of what she owns. Like one of the horse and half of the stuff you gave her. Even if you do have to pay support it won't be that much and probably not enough to cover the emotions of losing one of her horses. Get what I mean?
