if i call my stbx to find out how my son is doing or where he is, and her entire family avoids my phonecalls, or lies to me about his where about's. i want to know is there anything thing stipulated in the alabama state law that states this can't be done, or am i just screwed as far this goes?

I looked around & found no particular law requiring them to stay in contact with you, which is kind of the same law thats going to protect you if you go down there, pick up the kid, and take him back to Ohio with you. Look up "interference with custody" and "alabama" in Google & you'll see that this is only a problem in Ala if you have no right to the child, which they've not yet stripped you of your rights.

However, based upon thier behavior, I'd be surprised if that was not what they were working towards. You really need to move faster than to wait another 2 weeks. It sounds like they're trying ot hide this child from you and you need a lawyer to help you out if you don't want this to happen.

Is it possible that she's found this forum? If so, maybe best not to discuss the date outright? I guess if you go down on Friday & the kid is nowhere to be found & they would have no reason to believe this would be any day out fo the ordinary, I'd get suspicious.

well, i just got a phone call from her atty. !@#$%^ it. i having a bit of a panic attack. but i was told that the stbx is on a payment plan over 3 months. i hope that gives me enough time. oh by the way, she wants it uncontested. i just can't push myself to go that rout.....................

If they want it uncontested they'd better darned well pony up with some visitation time with your kid if you drive all the heck to Alabama for it. They're not exactly showing good faith here.

Not that you were going to leave the kid with her, but she had ZERO cause to withhold him from you altogether, and here she does, and THEN she has the audacity to want an uncontested divorce? there's something wrong there. Get yourself to a lawyer & get some temporary parenting time immediately.
