Concurrent pay

Has anyone who divorced prior to 2003 run into the concurrent pay issue? My divorce was final in 2003 and my ex-husband awarded me 50% of his retirement and 50% or his disability (against his lawyers wishes - but he said I was due it[smile]). Now that the law was passed on concurrent pay for retirement and disability he wants to only pay me 50% of his retirement. Isn't a contract a contract? Can anyone help me?

It depends on what state you were divorced in. Retirement pay is 1 issue but VA disability is another and it has changed considerably in the past few years. I am a retired FEMALE Officer with both retirement and VA disability. My ex-husband is intitled to 1/2 my retirement 20/20/15 because he suffered so much while I was on active duty as a Registered Nurse making $85,000 a year working three 12 hr shifts a week while I worked 80 hrs a week, deployed for $50,000. He doesn't have a civilian retirement so I get nothing from him. I am 100% VA disabled after 24 yrs in the Army jumping out of airplanes, running 20-40 miles a week, metal replacement parts throughout my spine neck & back , metal knees and can't work AT 53 YRS OLD and he gets 50% of my VA disability. I guess as the saying goes what is fair in love and war. I guess I should have stayed home with the kids. You need an experienced lawyer in military cases because the laws change every year especially now with the new VA rules and according to the states.
