Filing for Legal Seperation

My husband and I have been living in separate residences since the Fall of 2005 but not "legally". I am finally filing for a legal separation now that there appears no hope of returning to our home.

My question is where do I begin? I found forms online for $30 that are the appropriate filing docs for NYS. But once we sign these papers, what do I do with them then? Do we go to court, etc?

Sorry totally lost on how to do this "legally".

Thanks for any advice you can provide.

PS We have no kids, and own no property together. I already moved my stuff out of our apt two years ago. We just need the paper to make it official finally.

The settlement agreement only needs to be signed and notarized , it needs be included with the nofault divorce petition after 1 year of legal separation to recieve the divorce .

Sorry just thought of one more question (well, two).

I'm reviewing the paperwork and it looks like there is a space for two notaries to sign. Does this mean my husband initials and signs separately and he has it notarized. Then I take the docs and do the same, separately?

Also, do we have to initial the doc in front of the notary or can we initial in advance and then just take it to notary and they stamp and sign?

sorry, that should cover the last of my very stupid, but oddly important questions...thanks.

>>>>>>>>>> Yes , both parties need to sign in front of a notary and provide proper documentation ( a driver's license will do ) .

>>>>>>>>>>> Initial in advance if you like , the signature is what's important .
