He has 100,000 in 401K and bought our house 6 months before we were married and we moved in together after closing. Yesterday, after 2 months of marriage, he presented me with separation papers. He is offering me nothing. I quit my teaching job to move into our new house which he paid for and now make 7,000 less a year. I do not want to separate, but of course don't want to be with him if he doesn't want me. He has been paying all of my bills since I quit my job to be with him. Is this right? Should I see a lawyer or walk away with nothing. Am I entitled to anything other than the items I didn't give away before moving?
After 6 months, you're not entitled to much. Perhaps ask for a month or two of short-term support to pay your rent until you get another job or get your job back. Sorry it didn't work out.
With a 2 month marriage, you are entitled to little or nothing, unless you paid part or all of the down payment on the house. You are entitled to 1/2 the increase of the 401K that occured during the marriage...or 2 months worth. If he's willing to pay for the legal paperwork for divorce, I'd walk away. Your attorney and divorce decree could easily be a thousand or 2, even with the divorce being uncontested.
