Mother wants to terminate parental rights?

I have sole custody of my 3 year old son, his mother expressed to me tonight that she wants to terminate her rights as a parent. I was going to go for food stamps but chose not to because they were going to pursue her for child support. I've already spent 4,000 dollars in legal fees, if they pursue her for child support and she counter sues, there I am again paying legal fees for child support I didn't want in the first place. Her thinking is that if she terminates her rights she won't have to pay the support and I can get benefits. I told her that if she wants to it's her choice but my attorney told me recently that they don't let parents do that. In family law TPR or termination of parental rights is taken very seriously. Is that true? My sons mother seems extremely ready to do this. It kind of caught me off gaurd since we had just reached an agreement on visitation and as much as I'd like to think that shes doing this to be nice, I think there may be more to it. I mean who would really want to terminate there rights? She knows full well what it means too, she explained it to me. Sounds like shes done her research. Any input would be appreciated... Thanks

GEEZ....I dont know. Here, if they want to give up rights, they let them....no childsupport but also no visitation

what state are you in?

she either has major issues and doesnt want to be in her childs life......OR....


she wants to give up her rights on paper, to avoid child support, but thinking that you will not interfere if she wants to be around the child...wants her cake and eat it too.


I really dont know. Go google your state's family laws and see what you can find, if you havent already done that.

Usually the courts won't let someone voluntarily terminate their parental rights unless there's someone ( your spouse ) willing to adopt . Contact the Florida Dept. of Revenue to establish child support ( no legal fees ) .

I am fairly certain that she will be unable to give up her rights unless you are remarried and your spuse is willing to adopt.

OR

If the courts deem her unfit and terminate her rights for her.
