I've been asked to help my sister in law--unfortunately a little late. Need some advice on what we need to do. Unfortunatley, after seperating she bought a house but has no equity. Three kids are involved. She is the primary bread winner as a realestate agent. He had his own business but has since seperation, liquidated the business with minimal records (mostly cash). The house they lived in as a couple was inherited by him. He paid most of the home bills (elect, water, etc). She paid everything else. Including car payments and food. He wants to go to trial. Seems like he has positioned himself pretty good (no money, minimal job, and inherited home). However, he does have drug bust in early 90s. She has a lawyer, but he doesn't seem motivated. Probably not enough assets. The ex husband says he wants custody, half the equity of her new house (none available) and child support. Any advice.

How long were they married? How long have been separated, and where do the children spend their time now? While married, who spent the most time at home?

Married plus or minus a year --18 yrs Separated 6 months In separation children spend most time at mothers. Currently, oldest son (17) is in National Guard education camp--court ordered until Dec (started in Aug). Two daughters (12 & 9) stay with mother. Oldest daughter never visits dad. Youngest daughter once a month.
While married, mother was primary bread winner but still spent most time at home.

Update. I had a conference with sister-in-law and attorney. Got attorney energized some. Trying to get temporary orders with custody of all kids and back child support. Also, will bring up husband liquidating the business to judge. Husband seems to be caving in some. He doesn't have much money and his attorney has not been paid so far. See how it goes.

In most states your sister in law should be entitled to 1/2 the equity gain in the home, even if it was inherited, for the amount of time they lived there together.
