Divorcing after 7 years of marriage. We both worked through the marriage. I put my education on the back burner so she could obtain her bachelors degree. I was the one to do all the chores, most of the cooking, homework with the child and did most of the raising of our child.

It is clear that her decision was to leave me after she obtained her degree and so she could start her new life with her ex. What makes this subject worse is that for the past 4 years she would intermittently take our child to visit him in another state while I stayed back at home taking care of the house. I didnt know he was her ex until .5 months before I filed for divorce. Then she confesses to me that she has been romantically involved with this man for years. I want spousal support so I can go to college and get my degree only. I wonder if I can get it.

Spousal support would depend on each of your income levels. Do you have custody? It sounds like you do. You would get 17-25% of her income (depending on the state) from that alone.

We each make around 40K per year. She makes maybe a few K more than I. We have joint-legal custody. Since she lives out of state, it was ordered that I have physical custody the child roughly 9 months out of the year; however, she is contesting the original order. Trial is pending. Still think I have a chance?

I doubt you will get spousal support since your incomes are similar. But you should be getting child support considering that you are the custodial parent.

No chance for alimony, but you should be filing for CS.

You may be eligible for reimbursement alimony if you supported her while she persued her degree .
