oh please - he doesn't feed the kids? entertain them? provide transportation for himself and the kids? he doesn't eat? I could go on.... living is more than subsistance for you both. Maybe what you guys need to do is go 50/50 on parenting time and then whoever makes more money pays the modest CS that would be required and you both work hard and provide for the kids when they are with you.

50/50 time would be impossible. He works from 3:00 pm till midnight. Kids get out of school at 3:00pm. I pay insurance for our kids at $300.00 at month. So I really wouldnt understand a judge lowering it.

I'm fresh out of college and pay close to $800 /mo for 1 kid. You got screwed if your only getting $775 for three - that - or he makes 1.75 / hr.

That is that thing I want to do is "break" him. So if I got screwed oh well, the sad thing he still refuses to pay that amount. I was just wanting to know his chances of actually getting that amount reduced.

I seriously doubt he will be able to get it lowered.

Is it being garnished from his wages? If not, I would get that set up. This way he can refuse all he wants, but he still pays.

There is no way he will get that lowered. In fact his lawyer has a ethical issue. His lawyer should be telling him he is luck as hell. I agree that it too much money for someone to pay in one month. I can't imagine paying htat much, but I pay a lot more than half that for 1 kid. There is no chance it will get lowered. Here is the [censored] of it. You will most likely get the same judge and when he gets done with this stupid shit he will pay his lawyer your lawyer and they will actually raise the support and most likely shove him in arrears and he will pay interest and fees. Not only that is he will quit paying and totally wreck his life before he figures out he should have just started paying and punch holes in the walls.

I think the system sucks I think child support is more of a punishment than financial help. I think the courts are bias and I will be willing to bet there will some huge tragedy someday that will actually change it, but not paying will not fix the system

He will just be classified as another dead beat dad. I am not sure how long this will go on before everybody starts to understand that this is not right for anybody especially the kids.

Trust me none of this is any good for the kids and is definitely not in the best interest of them.

Anyways in my long winded response you have nothing to worry about and you should talk him into not going through with this and his lawyer should be disbarred. That is my opinion

For THREE kids?

It's not enough to be paying for that number of kids.

It is being deducted from his check, FINALLY. I have to agree, that $775.00 a month is not an extraordinary amount for 3 children. I spend at least $160.00 a month in lunches plus insurance. He just never had to realized how much it cost to raise 3 children, even when we were together, he was never the one to actually pay for the kids daycare, lunch money, sports, etc. But someone needs to open his eyes about expense that comes with the 3 kids. He told me, that if I agreed to $400.00 a month that he would'nt go back to court. Needless to say I laughed.

he can refuse to pay all he wants but all you have to do is file contempt of court and they will make him pay. the 3rd time i had to do that, the judge wouldn't even let him leave until he paid the $1200 he was behind. he was handcuffed and shackled and held in a room where he was allowed to make a phone call to his wife to bring the money. the judge told him he wasn't leaving the building this time until i had my money. needless to say, he can't refuse to pay....
also, on the first issue, i don't know about the laws in your state but in my state, this re-opening would just piss a judge off and he would get nowhere.
You don't have anything to worry about.

$775 a month for three children? What state is this? My friend has two children and he pays 1500 a month. Of course, this is California and his rent payment is only a hundred more than his CS but still... Your ex should be on his knees that he's not paying more.
