My ex is consistently not paying support on time, admits to having spent my portion of medical expense reimbursements from ins. for our disabled child and says he cannot pay since he is on disability. He is remarried (3rd wife) and neither of them work so, in essence, he is supporting himself and her because she chooses not to work, on his disability checks. How do I deal with this? If I take him back to court, can I fight for legal fees to be reimbursed to us by him? Anyone know the approx expense we are facing if we do take legal action? Is it possible to take him to court without legal representation? Any insight would be appreciated.

I read your past posts. You are within your rights to collect past child support, but are you sure you want to "ignite" this guy? He sounds like a bad nightmare. I'd weigh the benefit (or demise) to the child to decide what to do.

What kind of disability does he receive ? Have you applied for disability payments for the child ?

You are right. This is a major concern for us. As each year passes, we are thankful that we are closer to the end of dealing with him. However, as my son gets older, his medical needs are increasing. He will be able to atted college and I had someone close to us point out the fact that our son deserves that money to help him with college tuition and starting out his life, in which he hopes to be independent. We are debating this issue right now. It's a tough call for us. Thanks for your input, it is appreciated.

I'm not sure because he is so volatile, we avoid contact as much as possible. He receives 75% of his previous pay from his former employer. It is considered long term disability. We have never applied for disability for our son. Honestly, we never gave it much thought, or even realized it was possible. Can you tell me where to start? Thanks for your repsonse. Any and all info is welcome.

You need to find out what kind of disability he receives . If it's SSDI , the child is eligible for the family benefit .
