I purchase a property prior to marriage (from parents) and the property is vested as an unmarried woman. We have been married five years and the property has now tripled in value. We did not live in the property until the last year of our marriage. The mortgage was paid via a spearate account and his name was added to the bank accunt last year, all deposits to this account were made by me. Does he have any right to this equity? Deed is dated prior to marriage but was not recorded until recently. Thank you for your help.
Probably not. Community property does not include property brought into the marriage, just property obtained during the course of the marriage. Get a lawyer. It will be worth it, given our property values in CA.
