First of all, I am not a predatory,I met my boyfriend after his separation, he filed for a no-fault divorce.Unfortunately, his ex caught us having a relationship and re-file for a fault divorce as a ground of adultery, my quesion, does it really matter for committing adultery AFTER separation about asset division or anything else? after all, it is not me who broke his marriage.
The reason she did that is because it is still considered adultery even if he is separated. There is no legal separation in SC.
If it goes to court it will depend on the judge-but worst case senario is he will have to pay alimony, may have to pay her attorney fees, and he may get less than 50% of the assets. Adultery typically does not affect child custody.
The good news is that if he is found guilty of adultery-he can be legally divorced from her in 90 days.
