I posted this one before but cant find it now so here it goes again.
I was kicked out of my house 6 months ago and I found out 2 months ago my wife has a ex-con living with my kids. At first I thought it best to give her the house in lu of child support but Im having a hard time getting over that fact my kids are living with this guy. I dont think he will harm the kids but Id like to get them. I havent talked with a lawyer but I was wondering if it was even possible to get the kids? Some days I just want to be friendly with my wife but not a day goes by were I wish I had the kids living with me and ive even asked for them and she gets the house.
Are you divorced yet? Is there a temporary custody plan in place, if you are not? Living with an ex-con may or may not play a role in a custody decision.
You have a major problem here beyond custody. You can't give assets in lieu of child support. You could give everything you have, and if she files for CS, she will still get the full amount.
