My daughter turned 18 in November and won't be moving out until she goes to college in September. Does Illinois law require child support until she moves out or graduates from High School? My decree is from 1987 and I now live in Colorado. does that matter as well?
One question first. How can a decree be from 1987, but the child is only 18?
"Does Illinois law require child support until she moves out or graduates from High School?"
Neither. In IL, unless it is specified differently in the decree, CS ends when the child turns 18, whether they are done with high school or not. So, November should have been your last child support payment.
I agree on child being born before 87 and just turning 18. However in Illinois child support ends only after the person ordered to pay goes to court proves child age, that child graduated and that all obligations are met. So birth certificate hs degree etc. The person being paid can agree all is met or contest. For college this is where it gets ugly. custodial parent can petition for child support, college tuition etc if child still lives at home. I believe obligations end at 24 in Illinois. In most cases all cost will be divided by 3 with mom paying 1/3 dad 1/3 and child 1/3. now child moves to college means she is legally living under your roof so that keeps her qualified. Moving out on her own I am not sure.
As for you moving out of state I am not sure what that does.
sound like that child should be introduced to something called the facts of life... Try getting job applications for them to get them started earning wages.
If they are in college then maybe they should get an apartment of their own so that you can help support them withe the father.
