Legally Seperated?

My husband wants a divorce and told me that once the filing process begins we will be considered legally seperated. Is this true? I thought you actually had to file for legal seperation. Help!

You're correct , legal separation can only be granted by a judge as an alternative to divorce .

Thank you. :) So, now I have another question: my husband wants me out of the house ASAP but I'm refusing to go anywhere. Is there any way he can evict me?

No , but either party can seek exclusive use of the marital home in a petition to the court , if ordered , one party would have to vacate the house.
