Back child support

I live in Wisconsin and my ex was only ordered to pay $75 per month for 2 girls and ended up getting behind by $11,000. He's either worked for cash or not worked at all. First I should tell you that the youngest is now 23 so it's been 5 years since support has been cut off even though I sent the youngest girl through 3 years of college. About 4 times a year I get a check for $20 but the interest is close to $60 per month. I called the child support agency (Burnett County) 3 months ago and was told they've given up trying to collect, that he's "unemployable."

Any ideas on what I can do? Do I have to go through a different agency to intercept tax returns or lottery winnings? Should I hire an outside agency or am I just out of luck?

WI is proficient in setting up income tax interception, so he must not get refunds. If he won the lottery, that is also covered (in WI, they check the CS register before issueing winnings). At this point, you could hire an outside agency, but I suspect you will continue to get the $80 a year. The private agencies actually have less tools to go after him, but can be more aggressive. Does he have any assets that you can ask the court to put a lien on?

I would also ask the child support agency to go after this guy using the law that is available to them. Such as taking the drivers license away and jail.

I don't think there's anything you can do now. I would continue to call regularly, make sure they keep tabs of his circumstances and if they change for the better (e.g. he wins the lottery), you should be able to collect.

Thanks KGrow, that's what I'm going to do and Jada, no, he doesn't have any assets. What little bit he has, he spends at the bar.

Do I have to request an income tax intercept? A friend of mine never did that but still got them from her ex.

Susie...I am new to this, and wondered if you could tell me. If two people separate before the divorce, does the husband still have to pay back child support, if they both decided to split up, and do 50/50 custody? Or anyone else here...that may have an answer.
