I'm married with 2 kids, husband has decided to take all money away from me. He emptied the bank and opened one only in his name (he is still living in the house with me). Does anyone know what my rights are? I'm in school and when I get my student loan, I want to open my own bank account, would he be able to have some of that money if we were to divorce (I'm going to have to live on that as well as pay it back in a few years since it's a loan). Do I have to tell him about my money from the loan that's in an account if we divorce?
You will have to reveal you have the money, but in court when it shows it is student loan money, and you are attending school, it will be awareded to you, along with some verbiage that states that you will be responsible for paying back your own student loan.
In most states it is a violation to empty a bank account after Divorce papers are filed. When you consult your Lawyer he/she may want to file a Motion. I hope I helped....
unfortunately, we are still living together. I'm in a stuck relationship, 2 kids, in my 30's in college and haven't worked in 12 years since I had my oldest child. It's a mental thing going on here, like the emptying of the bank account, to control me. I plan on leaving as soon as I can! So thanks for your input.
