So, my husband is filing for divorce and has already seen a lawyer. I am being told by him that he and I have to agree on a "move-out" date for me and that if I don't agree to move out before the divorce has been finalized, he can go to his lawyer and make me leave. Is any of this true? We're married, I thought I had every right to be here until everything was final. Once the paperwork has been file are we still married? Or are we considered divorced but not finalized? Arg, I'm so lost.
You DO NOT have to leave the marital residence until ordered out by a judge . He and his lawyer can say whatever they like , until he has been granted exclusive use of the home , you are free to live there .

NicoleCMT, No, you don't have to leave. And don't give the impression you are going to leave OR leave then come back. Depending on how nasty his attorney is it only gives them more things to use against you. You are still married until the paperwork is finalized (could be as soon as 6 months but don't bet on it) Next, go get an attorney. Stand your ground. Find friends and family for support. It will be tough but you will find you way.
