I've posted this in divorce forum as well. But may be someone here can help too.
I'm new to all this & since its still raw, it is very very painful & then I've to face all the reality as well which basically narrows down to actually facing this nightmare & supporting myself. So here it goes:
My STBX inlaws & my parents live here in Tulsa, OK & thats where we got married in May'05. I moved to live with my hub in Irving, TX right after marriage. Even though we visited Tulsa alot, we resided in Irving, TX. He worked fulltime there & I worked part time. Did our taxes there too. My name was on apartment lease & on dishnetwork.
Now since 12/22/07 I'm at my parents & on 01/18/08 I received the summon from Tulsa, OK court for divorce from him.
I wanted to get things ready before I speak to my lawyer so I called my apt leasing office & boy were they rude. First they said, they won't let me have proof, then said your hub told us you took everything so we are taking your name out, I informed them that on 01/17/08 I just took my basic belongings (my car, most of the clothes (not all), shoes, & books). So she said she'll fax it to the # I provided, but she never did.
I'm gonna ask IRS to send me our '05 & '06 returns. I can figure out how to get my proof of last employment.
Q#1: I want to know is it in my favor to inform the court that legally this case should take place in TX not in OK? (now I wonder why my husband never let me change my OK driver's liscence to TX & his as well).
I currently don't have a job (he made me quit), living with my parents, will need a lawyer but can't afford him, & he does not want to give me anything. He has 401K.
I've a foreign M.S. degree which equals B.S. degree in U.S. in Nutrition. But never got a chance to finish my last semester after marriage. I made $12,000 in '06 & $18,800 in '07 in retail job.
Q#2: Do I qualify for spousal support? BTW I think he made $32,000 in '06 & $39,000 in '07.
Q#3: Not so important but still what can I do about the leasing office's refusal of help?
Can anyone answer all of above questions, please?

Does it matter? They are both no-fault states. If you divorce in TX, and have disagrements, you will have to travel to TX courts, and probably have a TX attorney. It's actually to your advantage to divorce in Tulsa.

Q#2: Do I qualify for spousal support? BTW I think he made $32,000 in '06 & $39,000 in '07.

No. Spousal support is for long term marriages. You have been married less than 3 years.

Not sure what you want from the leasing company, unless you are trying to prove you lived in Texas. If you jointly files your taxes in Texas the last couple years, they is probably enough.

You are entitled to perhaps 1/2 the increase in value of the 401K since you got married. This could vary greatly. With the mini stock market crash the last month, many retirements have lost much in that time. Do you have liabilities, such as credit cards? These have to be split also.

#1: It makes sense. And I know its going to be hard for me to travel to TX & all. I guess I just want to make it hard for him (or his mom).
I've been a good wife; may be thats why he never told me face to face. He INFORMED me he wants out over the phone in a four minute one sided conversation & he was furious (worse part; I could hear his mom say things & he was repeating them to me).
Even though 2 days before that he said he wanted to start a family, that he loved me dearly & will miss me when I'll be at my mom's for a day.
#2: Leasing company was only important to proof I lived there. Now upon my hub's request they are renewing the whole last year's contract without my name in it so he prooves I never lived there (I did get my necessary belongings on 17th jan. but less then half of my clothing was still there).
But I don't think it matters anymore as ppl in my other post have said that I could a subpeona.
No credit card balances as we were planning to buy a house. But I did enroll for my course after marriage which is worth $2,000. And my medical bill is about $650.

do yall live in TX now or OK and if so how long? By law you have to live in the state 6mo and the county 30days before you can file. and when you go to messing with two states ur looking at getting two lawyers...i did the same thing between OK and TN. so far i have paid out 10,000. and havent even went to trial. that was just on the establishing juristiction. besides it makes it drag on forever when you get things thrown out and stuff. its been almost a yr since we filed and we still havent gotten anywhere. its a painful process, good luck to ya!

Thank you for responding.
I've been in OK since late dec.'07. He is in TX. It is mentioned in my post above.
I know about the residence req. & thts why was wondering what would be in my favor & legally should I inform them and all that.
You are right, I'll only drag myself more, and I don't even have tht much money.
He works for airline, so flying is free for him & his family anywhere in U.S. whereas I'll have to worry abt travelling expenses.
I don't know what to do.
P.S. we don't've kids.
