Does anybody know whether the servicemember keeps on getting bah after the divorce. My soon to be X says that all he has to pay me is childsupport for our daughter and that he will lose all of his bah when the divorce goes through. Anybody know?
My ex claims the same thing- I am not sure. I don't believe him though. I remember when I was in the military a few years ago, unmarried soldiers with children still received BAH. They were allowed to live off post whether their kids were with them or not. So why would it be different because of a divorce? The only thing I would assume is that it may be less...but I doubt it would be reduced to $0.
Done4, I have looked at the pamphet I got from my local JAG office and this is what it says about BAH.
MILITARY MEMBERS Basic Allowance for Housing (BAH) You may be able to collect BAH at the dependant rate if your divorce decree or seperatoin agreement calls for child support. This money must be used to properly support your dependants; otherwise, it can be terminated.
Basically, the answer is yes but child support needs to be put into writing into the decree. He then uses that decree to get the BAH, then you get the money to support taking care of the kids. I know from experience that this process doesn't always work. good luck
