My dear stbx allotted me 1400 a month and said that is all I get. But mind you I still have all the bills. What the hell? I'm taking my papers to the lawyer on Monday. He is a major over 22 years.....any advice. Or should I be happy I'm getting anything.
Done4 Based on some of your previous posts and what you just mentioned about him being in for 22 years, I don't know the pay for an O-4 (major) off the top of my head but you may be entitled to more. Especially if you have kids at home. I was an E5 back in 93' when I went through my first divorce and paid more than $1400. Thats why I took a second job at the time. I ended up having to pay for spousal support for the first year so she could get herself on her feet. She also had the kids.
Well, I called jag and they said that he didn't even have to pay me that much and that he was entitled to keep his BAH and family sep pay and whatever else. His base pay is 6500 a month not counting his bah and cola and family sep pay. Oh well, I give up guess I'm [censored]!!!
Don't give up. Find a good family lawyer that understands the military or at least has some knowledge. I am not sure of the rules where you live for support but I would think you should get more. I know you probably deserve more. Now that you have dealt with the JAG it is now time for a good attorney. I know its hard to get around but try not to settle for an attorney that you don't feel comfortable with. Any support would probably not include seperation pay but the BAH should be included in the calculation for support.

Get a lawyer that is familiar with the military. The BAH for the family goes to the family, not him.
What you need to do, if you have kids, is file for child support and temporary spousal support.
In the meantime, any bill with just his name on it doesn't get paid. It gets forwarded to him to pay.
