My husband's ex-wife is threatening to re-open their divorce case (it has been less than one year) claiming that she thinks my husband (her ex) and I started seeing each other prior to him moving out of their home and not after he had already moved out. Basically accusing him of having an affair, which is totally false. Would the state re-open a divorce case with such a frivolous accusation? There are no children involved, no assets were divided, and no alimony or payments of any type. She also makes more money than he does and always did during the course of their marriage. Just a simple non-contested divorce. Any advice is welcome. Thank you!
I'm not sure. Again, she owned the home they lived in and it was only in her name. She made more money than he did during their marriage. I briefly read their divorce decree and there wasn't any assets that were divided - it was basically I take my stuff and you take yours. She is also threatening to sue me because she believes that if we were having an affair, it led to the end of their marriage. Her accusations are completely false and I have many friends who are witness to our relationship and how/when it began. I have never heard of a lawsuit because you think someone cheated with your husband?
I would completely ignore her. Unless she's loaded, she's going to have a hard time finding a lawyer to help her with this. If she actually does manage follow through on one of her threats, you'll have plenty of time to put together your defense.
That i9s one of the most weird news i have heard for a long time. You dont have to worry a bit on this. You have nothing to loose. In case yor partner (ex) tries reopening the case it would be her loss. So chill. ...................................................
