Is it possible to go to final trial without having seen discovery from your stbx? I'm beginning to think so. It has been eight months and he and his attorney have managed to stall thus far. Any comments and suggestions are welcomed.

how can your attorney even plan your case without this?
my stbx stalled and stalled, and my attorney filed some motion or paper or something to get what was needed.

My thoughts exactly. She said that I had gathered quite a bit of information and I did have his income record. I asked how we could legally get his 2006 tax return. We filed separately, as he demanded, evidently trying to hide something. My attorney told me how it could be done. I said, "Then, let's do it". She, typically, said "Let's wait". I got extremely nervous at that point and talked to another attorney. He seems to think I will get a court date within the month regarding a motion filed for discovery sanctions. After that, he said to call him if I need to. I get the impression that he doesn't want to take the case in the middle of it all. I have lost all confidence in my attorney. I am very worried. My stbx has avoided turning over discovery since the divorce papers were initially filed on 1/31/07 and he told me I would never see his W-2's. It is on my mind day and night. That is the only life style I know anymore. He also cashed stocks, payments mailed to a different address, has written many cash checks. He has planned this divorce for years. Then decided to file after his girlfriend's family harrassed me 1/27,28/07. Three days later, he filed. He had stayed married, refusing to discuss problems, in order to hide money. I have a full time job just trying to get evidence of his accessible money, of which I had no control, since the stocks were only in his name. His attorney told my attorney my stbx used the money to support my daughter and myself. He did not and I will prove it. I am on my own here. I feel my attorney wants me just to accept his lame excuses. So far the court has ordered him to pay a few hours for my attornet fees. That seems to keep her satisfied. I still don't have discovery. While we currently wait for a court date for sanctions for no discovery, we already have a divorce trial scheduled for Feb. '08 with the magistrate. Is the final trial with the judge or should I now worry even more? I'm very concerned about the final outcome of this fiasco.

Just a follow-up note. I now have a new attorney. He listens and does not waste time. My stbx turned over the discovery. Depositions are in the future for my stbx and the girlfriend.

I was wondering if you had the deposition done yet? I am going through a similar thing with my ex where she is unwilling to turn in her discoveries.
