my stbx has stated on several different documents that his income is this or that!!!
I've been told by several different attorneys that I can just have his tax returns subpoened.
Well, I called the IRS and was told I couldn't!!
The IRS has a disclosure law which is a federal law and that it supercedes state law.
I just wanted to post this and see if anyone else has come across this

In NJ, Tax returns are a standard part of the disclosure step before property can be divided. If they aren't supplied by the parties, you can be held in contempt of court. Maybe the IRS can't provide you his returns, but I believe he can be subpoenaed to do so by the court. So, he would provide them. Not the IRS.

Someone actually called me back from the IRS Disclosure office and they said because we filed separate returns (His idea, not mine!) he would have to give authorization for me to get his returns. Well I know the answer to that so I will just subpoena him to turn them over!
I noticed it wasn't in the Request for Production (Discovery)!

i'm confused...wouldnt his atty know they could be forced to produce..so why not produce the darn document! So silly. Or maybe he's gonna produce a fake one? how can you know it's real anyway?
