Credit Card Debt Question

My husband left the home at the end of January. He originally told me he owed $10,000 on his credit card (we both have our own)and that would need to be paid off when our house gets sold and my card will also get paid off. Now all of a sudden the $10 has turned to $17,000. Is the debt incurred AFTER he left considered marital debt? He may be using the credit card to pay for the mortgage and health insurance payments, I'm not sure yet. IF that is the case, wouldn't he have been responsible to do so anyway since I have our child and am not capable of making the payments because I pay all the utilities & food expense and have only worked part time for the past 10 years?

IF you have not filed papers yet...well, it could all be maritial debt.
IF you have filed papers Hopefully there is wording in there stops him from being able to charge on your name AND that keeps each of you responsible for your own debt...that you incure AFTER filing....


as for marital debt...it IS split regardless of your income and working. i am responsible for half the debt of our marriage including income tax the year i filed...and I was a sahm mom for YEARS!
now...the debt incurred since the filing...THAT is each our own.

if you havent filed and he is incurring debt you need to file asap.

I agree with Taryn, divorce is stupid and messy. It is so hard financially. I've been a sahm for years too but everyone is all of a sudden expecting me to pay for this and that and I'm like hey! you can't squeeze blood out of a turnip. But the court system doesn't care. Whatever you accumulated during the marriage is both of your responsibility. Hopefully whatever incurred after the paperwork is filed is each to his own. That is what I've been told though. Hang on honey, it will probaly get worse before it gets better but it WILL get better.
