i have been making 50k a year as long as we have been married i didn't go to college she has a college ed and has been making at least 90k until she was laid off 8/07 she is making more on unemployment than i am working so how would support work in a case like that.....anyone?
A bit more detail is needed to determine the answers. How long have you been married? What will the custody arrangement be?
You'll want to research your state's guidelines for alimony. If your wife was making 90K at present, that's quite a difference in your incomes and depending on how long you were married, she may have to pay you some alimony for awhile. Most marriages that include alimony are long term, 10 years or more. Though I'm not sure in PA what is considered long term. If you were married only a few years, you probably won't get any alimony, but anything can happen. If your wife is currently unemployed, I can't imagine she is making $40K more than you anymore. So it will depend on what you two can agree to or what a judge decides. You don't make zero, so a court may decide that $50K is enough for you to support yourself. Alimony just depends on so many things that it's hard to say if you'll get it or not.
As far as child support, it depends on how much time each of you will have the children in your care. If it is 50/50 or close, the higher wage earner typically pays the lower. If it is 80/20 or any other percentage where one parent has significantly more time than the other, the parent with less time usually pays the other parent, even if the other parent earns more.
