I am currently going through a first time divorce.
I am conerned about Debts as all marital debts were in my name due to me having better credit and such.
What is Utah's Law about Debts and distrubution even if they were in my name. HB is claiming that we paid our debts seperate which is not true. (I do have some proff). I asked him to file BK but he wont because he doesnt want to pay out. What is the law on this?
I look forward to hear from anyone that could give some advice on what to do.

I have a divorce lawyer and he is telling me to file BK. I feel really angry over this situation as I am the one who will suffer the credit sitaution, not the soon to be ex.
Should I just get over the anger and file or should I fight this to make him also responsible? Husband thinks he is getting away with not being responsible as he did in the marriage.

You could probably get the judge to order him to pay half of the debt. But that doesn't mean that he will. And since it's your name on the debt, the creditors will come after you.
They don't care what your divorce decree states. They just want their money. And since your name is the one on the account, it is you they will come after.
