stbx had 20 days to respond to my petition, the 21st day was monday the 14th. i called my attny today and he said as of this morning the 18th there was still no response filed to the court. i know that if it is post marked my the 14th that still counts as responding, so my question is it safe to go forward with a default hearing? stbx asked me on wed if i heard anything regarding his attny filing, i told him that is what he hired an attny for and he need to contact him. by him asking that question i would "assume" that he has filed a response. i am not sure what to do.

Your atty should know what to do! You shouldn't have to make those decisions! That's what you pay them for. And, just because they didn't respond to the petition, doesn't mean it's done and over, unfortunately. Unless your petition included all the equity settlement stuff, you still have a long way to go.

let me clarify, yes my attny started the paperwork for a default hearing. i just wanted opinions here if i was on the right track. the petition included everything: spliting of assests and debts, custody, visitation, child support, medical coverage, life insurance, child care, and even changing my last name back to my maiden name. it is pretty cut and dry we don't own anything. i just wanted to make myself and my attny was not jumping the gun.
