So ex was court-ordered to pay back about $20K in support I paid her. She had 30 days. Those 30 days have passed, and a judgment has been filed against her. Her side offered me her house for sale, but I said no. So now she's talking of filing bankruptcy. Hmm...she hasn't worked in a year and a half....has received $50K cash from me in that same time-has received an additional $60K+ from our real property. She's remarried and is just about to move into a new house they built.
Can I go after her AND her hubby? This is a 50/50 joint state (MT)?

Her husband is not part of your order. The only person that you can go after is your ex wife.

I would assume the threat to file bankruptcy is a bluff. Stay calm and keep the pressure on. I don't think you'll get far going after her new husband. But making motions that direction would be a way to keep the pressure on.

Bankruptcy won't do her much good , domestic support obligations are a priority in any bankruptcy proceeding and are not always dischargable . You can't go after her new husband but can attach any jointly owned property .

In a roundabout way, you ARE going after both of them if they co-mingle their income.

She doesn't work nor has since she left my employ over a year and a half ago. Keeping the pressure on her....I'm not willing to let this go. Even if I need to appear in bankruptcy court - $110,000+ she's gotten in the last year and half, and nothing to show for it?? Things that make you go HMMMMMMM....
