Garnishment of Retirmement

I have a question about garnishment? If your divorce decree says you must pay though a garnishment and you were married less than the 10yrs (DFAS wont pay you directly) how can it be garnished. DFAS won't honor it unless it 10 yrs or more right? My decree says I get 114 months it does not say I get say 50% so could that hurt me? And if he stays in passed the 20 yrs and he may do so; my decree says I only get 114 months worth will that complicate things legally since it does not say a am entitled to a percentage amount of the retirmement?

Hi,

The formula is 50% divided by years of marriage (114 months) by time the member served. DFAS will figure out the percentage, if your paperwork is worded properly.

Look on the dfas.mil website, they have sample wording and the formula.

well if you use the formuala that they use it comes out to 23% not 50% plus we were not married 10 yrs, but 9.5 yrs.
