I am in the process of getting a divorce. I serve my wife then my wife served me. Will I have to pay for part of her attorney fees?

Maybe. That all depends on what the two of you agree to, if you end up dragging it out (same can be said for her) and what the judge orders.

It all depends on your state and the court. Liberal judges tend to believe that the "moneyed" party should pay all of the legal fees, particularly if he is a man. This factor has to be "netted out", however, by the fact that, all things being equal, the party to initially file for divorce is more likely to be ordered to pay the other party's legal fees.

The above mentioned, particularly annoying use of the passive voice in this way, suggests that these ignoramuses believe that money is like rain: some are lucky enough to get more than others, and hard work has nothing to do with it!

I too am in the process of getting divorced but my wife walked out and served me first and then I countered. The way my case seems to be playing out is that if we go to trial the "losing" party will pay the attorney fees and court costs. I want her to pay her fees and I'll pay mine. We'll see what happens though.

im on the nonworking wife side of this equation.

MAYBE you'll have to pay for your stbx wife,
but most likely not.
seems regardless each person pays their own fees.

In CA., it does not matter who filed nor does it matter what the reasons are. The person with more money usually pays for some if not all the the other person's attorney fees. I disagree with this principle.

I have been in the process of getting a divorce for a year and have spent $14,000.00. I filed and immediately had to seek a restraining order, and he has violated that order in excess of 30 times. I am perfectly willing to pay the standard amount for getting a divorce, but each time he does not cooperate and costs me more money, I feel like he should have to pay for those costs. Good luck!
