If a child is 19, works full time, lives with CP, but also goes to college is child support still in order? Or could the father have the child emancipated so he can stop paying CS? He is not included in any major decisions regarding the child, just told about them after the fact.
The father also pays 1/3 of the college costs.
This is in NJ.

What does the court order say? Mine says if the child is employed full-time year round, even while going to college, child support ends. Full-time employment in just the summer months will not end child support.

Maybe you could have him emancipated but my question is why? What is in the best interest of your son? If getting an education is then keep paying. Help him out as much as possible. Make it easy for him to get the education. Right now my ex is not forced to pay for college and my 19 year old may have to drop out because I can't afford to keep him there. I say pay as long as your kid needs it, regardless of the rules.

The father wants to pay for college. Just not child support. The "child" is making all her own decisions, now. Like buying a brand new car her father advised her NOT to buy. And blowing lots of money eating out and going to amusement parks.

A minor is emancipated at age 18 because it is no longer a minor but an adult. An emancipated minor must be under 18 or incapacitated by physical or mental handicaps ( over 18) or be recognized as emancipated ( i.e sole parent of own child& /or self supporting) if under 18. Pm me if you want - I worked in family court for ages...

Emancipation was defined pretty clearly in my STBX's divorce papers from his first wife. Don't remember the exact verbiage, but one of the bullets had to do with the age of eighteen and another was related to her enrollment in school. When the kid quit high school in her junior year, he was no longer responsible for child support.

In NJ, child support goes through college as long as the child is enrolled full-time (and if the psa states part-time, then even if part-time), with a max age of 23. This is on top of paying a portion of the college costs.
