Long story short-filed divorce papers in Aug. 07, spouse signed and notarized, so, uncontested. Waited 60 days as per the law to set up court date. Called 8th circuit Mon. am to set up court. Told I needed a motion to set-found on internet 5 hrs. later, filed. My question is How do I get a court date set to hear this motion to set. The clerks ofc. gives a blank stare when you ask a question about this, or if you call them, dead silence-which ofc. sets court dates?
I know exactly how you feel, in my case I went to the courthouse to file the paperwork, all signed and notarized by both me and my husband and the told me they had to have the judge sign off on them before they could be filed. When I asked the clerk how long and what the next step was she got beligerent with me and told me since I was stupid enough to do this without a lawyer she couldnt tell me what to do. When i called back the next day to check on the paperwork no one had seen them. Its been two weeks and they have not shown up yet, so I am back at square one. Needing some help desperately, If anyone can help me with the steps needed to file the paperwork, please. Also can anyone tell me what the costs will be? for a basic non contested divorce?
