Divorce Support Forums: Railroaded out of alimony; is it possible to chang
The Spousal Support Handbook The Spousal Support Handbook ($28.99)

Hello, I was railroade by my own attorney. He signed papers without my concent and it says "that neither shall pay to the other party, nor recieve from other any alimony. Not only that but he lied to the court and said he was only making 1500. a month and in actual he was made a partner in the business and hid that from me too. Please help. the divorce has been 3.5 yrs and he has not paid me for the house either. He is getting ready to sell the house and says he will pay me when it sells and is moving out of state.

Who is "He" here - your attorney or your ex? Who signed the papers? Both you and your ex must personally sign the decree before it is final. Did you sign it?

Is the divorce final? How did it get final without you signing the decree? The only way I know for that to happen is if you went to trial and the judge made a decision which was not up to your lawyer to do anything about the decision unless you were ready to appeal it immediately (and 3.5 years of remaining silent is way to long for you to wait before needing a change). Or have you beein litigating it for 3.5 years without settlement? That would unusual. Like KGrow says, it's not possible for a case to settle without your signature, so there's something missing in this situation you're telling us.

I'm under the impression, the main wage earner has greatly increased their income since the time of divorce, and the poster wants a piece of the pie post divorce.....although I could be wrong.
