my attorney wants me to pay down some more of my bill
and
i want to pay off my CC.

Just where did the money go? Was it a joint account?

If this divorce isn't final by the end of this year and you end up filing jointly again, get a paper check. Don't let it go direct deposit. Sign it at the same time as your jerk of a stbx does and mail it right there. Don't give him a chance to change it to direct deposit after you sign it.

And before you sign any refund check, make sure that he has already given you your portion of any refund ahead of time.

And be sure to let your attorney know that he took all of the stimulus. And that you were planning on paying towards what you owe with your portion of it.

I have NO CLUE!
ive asked him a couple of times and he wont acknowledge my presence (unless he needs something for the kids...LOL it's cool..i dont acknowlege his much either).

i know he filed something, or he said he did.
i havnt signed anything for 07.
he IMPLYED it was in HIS bank account.
but i dont really know.

all my friends are talking about how theyre spending their $$ so i know everyone's gotten the $$.
i just guess...it's too bad for me.

maybe ill call our accountant and see if how filed/paid
he's such a liar.

i REALLY need that money.

First, he's playing with your head. If he has not filed an actual return, then he didn't get the stimulus. It doesn't matter if you paid something, only the people who actually filed return are going to get it.

I would contact your accountant and see if he filed. And if he listed you on the return. If he did, ask who signed your signature to the paperwork because you didn't sign anything, he could end up in a whole lot of legal trouble if he filed married filing jointly and didn't get your signature or permission. With both the IRS and the family courts.

Once you know if he's filed or not, you will know what you need to do. If he filed married filing jointly, you need to contact your attorney and tell him/her what he did.

ill have to call this week.
he has to file joint/married or whatever as that's how our court system sets it up until finalization.

good point about him messing with my head.

ur post reminded me of how ez direct deposit is. And even if the acct is in both names, one can take it out and spend it. heck i've always done our taxes and ever since doing them electronically, she has no clue what the return looks like etc. Of course she literally has paid zero tax since 2000 as i have all her disability tax taken out of mine so i feel i'm entitled to 100% of ANY refund. Yet i was fair enough to give her her 600 bucks this year.

Having her taxes taken out of your check was your choice. If it had been taken out of hers, it would have had the same effect at tax time.

Any refund you get belongs to both of you. One way to see how you benefited from the extra exemption is to, well, compute your taxes as if you were a single person and see just how much you get back, if any.

thats not relevant because when you are single you have different withholdings. Of course when she leaves ill be adjusting via a 'dummy' return. I never would have had the same withholding all these years if i was single

If he didn't file, there won't be one. Are you sure he filed a return? I filed my taxes in March and I received my tax refund but not the stimulus check. I chose to get a check instead of direct deposit. Checks go by the last two digits of your social security number. Lowest to highest are how they are processed. My last two are high so I checked online. I wont see that check until the end of July, beginning of August.

It is relevant since you claimed you should get 100% of the refund. Since you got more as a result of being married to her and being able to claim her as an exemption, you are not entitled to 100% of the refund.

Like it or not, any refund that you get when you file married filing jointly belongs to both of you.
