So my husband and I have been seperated for alittle over a year. He was suppose to be getting the papers together for our divorce. Needless to say it's not getting done. Is there any way I can divorce him without him trying to make trouble. I just want to hurry and get him out of my life and make sure he stays out of my daughter's life.
after one year and one day you can file. He will be notified and will have 30 days to respond. NC is a no fault state. He can then respond and contest custody,ED, or terms of the divorce. He doesn't have to respond nor show up for court, but then the divorce will be granted and it will usually be granted giving you what you want. All of this will be explained in his notification.

If you are filing pro se, you send a registered letter to his last known address... if he doesn't sign for it and/or it is returned undeliverable, you will have to serve him by publication (run an ad in the classified (legal ads)for a week or 30 days).....I forget how long. In the event he still doesn'tn't respond, you go to court and have a judge rule on divorce. It takes longer by about 60-90 days.
