Unlike child support, spousal support is often very difficult (if not impossible) to modify after the divorce is final, so getting it right the first time is a must!
My husband of 5 years has just served me papers for a divorce...I am living in a hotel that he and his family own under somebody elses name..he has also given me a 60 day eviction notice. I dont work,and have no money to hire a lawyer. I am also a permanent resident sponsered by my husband. My husband has had many affairs throughout our marriage and even brought property in his daughters name. As we speak my husband is on holiday with his new girlfriend and I have nothing to eat,let alone feed our 2 animals...we have no children. I have no family of friends to talk to and I do not know my rights. We have a history of domestic voilence and it is not unusual for my husband to leave me parked in motorhome without food or money for a week. I am not sure what to do.
Contact an attorney (some will give a 30 minute free consultation) and ask about filing a motion for temporary spousal support. Are there any joint accounts? If so, go and withdraw half of the money in there. You can use that to feed yourself and your animals.
I would also discuss the eviciton notice with the attorney when you consult with him/her.
heed Jada's advice. Also can you find a women's shelter in your area to go to -- you may find people there with knowledge on how to move forward from this point.
