File for Divorce - WHEN

My ex has been gone since December - I have filed for custody and child support - I have tried to set up a property settlement agreement through my lawyer - we mailed it to him, but he refuses to discuss it. He has had no contact with me or his children (his phones have been turned off) since mid March. Once December (this year) rolls around, can I file for divorce EVEN IF HE WON'T work with me on property settlement? What is the statute of limitation on how long this can go on?

NC has abolished all fault grounds for divorce , either party may file for divorce after living separately for at least one year .

You have to actually live separate for a year before you can get on with the process? WOW!

what about property, etc. since he's not paying support, it's hard to make ALL payments - if worse came to worse, i may possibly have to sell the house - what are my rights on that? remember he's shown no interest in contact in over 3 months...
