Ok so I am in the Navy, got stationed in WA state. Got back from deployment wife wanted a divorce, I said yes, left for WA to be with family and find a different place to live. I paid for her to move back to WA also as planned since this is where we are both from. She cancelled the move. Said she would sign the divorce papers so I sent them, she turned around the next day and got her own drawn up and filed because she wants money!She said I have abandoned her, and I need to pay her, and that and the adultery are grounds for divorce. I have been paying her money every 2 weeks since I moved 1 yr ago. She put in her divorce papers that I abandoned her and am now living with a gf in adultery! WTF? She broke into my email and my myspace account and says she has proof of my indescrestions... this is illegal right?? Now she wants spousal support for another year! Not ony have I not been served even though she says the cops have dropped off paperwork but she is not being honest. Now she says she will be divorced this month and get whatever she is asking for, can this be true? We have no children, and I said she could have everything else, I have been paying her. She makes as much money as I do... So what are her chances of getting Alimony (married 5 years)? Also can she use my emails and stuff off the internet against me? How hard is it to prove adultery in VA? Do I have to be in court personally to tell the judge my side? I dont have money for a lawyer, or to fly over there for that matter since she takes it all, I am just stuck. I have called JAG who informed me that they dont help with divorces...Anyways,she says she will take the part where she wants me to pay for her lawyer out of the papers if I agree to pay her alimony for another year. I dont want to do this, but maybe its a good option? Please help me!!

Let me start by saying that I am not a lawyer and you need one. I am currently separated from my wife, in Virginia, no kids, and we are both in the same general income range, and she cheated on me. So far, everything is very amicable unlike your situation. However, I believe that Virginia is a no fault state when it comes to divorce...in other words, it doesn't matter who was cheating on who as far as the court is concerned. My understanding is that the only thing adultery can get you is a faster divorce, i.e. you don't have to wait the required 6 months (without kids) that you would otherwise have to wait, but you have to be able to prove it. As far as alimony is concerned, I believe it is figured based on a formula and you would have to make 2 times her salary in order to have to pay. As far as abandonment is concerned, that is where you are going to need the lawyer. I don't think it is illegal for her to get into your myspace account or email. Good luck and hire a lawyer in Virginia...you are in over your head.

Yeah, no-fault state so the cheating won't matter. She probably won't get any alimony. The abondonment might be an issue. Not certain. Check with a lawyer on that.

Ok, so do I need to get a lawyer? Or can I just fly over there to VA and stand before the judge? I talked to the court and they said that there is no court date that her attorney has sent papers that need to be accepted by service before there can be a court date? I am so lost. Doees anyone know some fair and decent priced lawyers in norfolk that I could talk to? She gets so much money from me already that I dont have much to spend. Thanks!
