I am currently finishing up a divorce. I had an uncontested, with 50/50 custody and no child support. My question is if i started the divorce with affidavits and everything is signed, can the judge just decide to not do divorces by affidavit and require you to come to court? This is happening to me, and are the affidavits still in affect? Next, i am seriously considering sueing for child custody. I have been hearing word of drug habits from there mother. I am in the military and currently tasked to deploy for 6 months. I in all honesty can not sit there and let the woman be responsible for my 2 children. How do I go about getting a court ordered drug test and how much will this all cost to get my kids? My ex and I do not have a bad relationship, i just want what is best for my children. I am just afraid that i will ruin a peacful situation.

You are going to have to have more proof other than hearsay. Because right now that is all you have.
Right now, you have more custody than what someone in the military would have gotten from a judge. So unless, you can prove it with hard evidence, you are better off not suing for custody. Because it could be the person who gets deployed to a war zone that ends up without 50% custody.
