Unlike child support, spousal support is often very difficult (if not impossible) to modify after the divorce is final, so getting it right the first time is a must!
Dont know where to start, but here goes,I live in Ohio and have had child support& spousal support from W.VA.taken from my paycheck for 12yrs;My x has been employed and has rental propertys,The kids are adults and have familys of there own.So to get to the point, belive it or not,the principal owed for child support is $oooo,oo interest owed is $25.977.17.--As for spousal support, principal is $3.573.30 owed.Interest is $23.765.91 Total interest for both $49,743.08 Im 62yrs. old and i have tryed to get help on this but have had no luck doing so.All responces are to get a W.VA. lawyer,I live alone and cant afford a W.VA. lawyer or to travel there to seek help. Anyone with a suggeston would greatly be appreciated.
The problem is, that there were arrears. And some states add on interest. And, to be honest, I agree with this. When one doesn't pay their child support, they are in essence forcing the CP to cover their portion of the child's expenses. Basically, the ncp forced the cp to give them a loan.
And as you have found out, they will continue to collect arrears and interest on child support long after the children have been emancipated. And apparently, spousal support as well.
You may be able to get it reduced if you get a good lawyer. You could always offer your ex a settlement for less than what you want, this would mean that you would have to give your ex a lump sum.
Of course, you could always contact your ex and see if your ex is willing to forgive the outstanding balance.
