Ex is trying to emancipate our daughter....

can he just stop paying CS? He filed to emancipate in May but stopped paying in January. Wouldn't his lawyer tell him to pay at least until we go to court?

How old is your daughter? What state are you in? Is she still in high school?

she turned 18 in december and graduated in June of this year. But he stopped paying in January. She hasn't decided if she's going to college yet.

What does your court order say about child support? He is probably going to have arrears. Typically it is 18 or graduation. Whichever one happens last. In your child's case, graduation happened last.

I would file a contempt of court motion as he is disregarding a court order and ask for a withholding order for the arrears so that it can be automatically garnished from his wages when this goes to court because he's going to be owing child support from January through June at the very least.
