I have temporary custody of my son during the divorce. The STBX wife has visitation every other weekend. I have been told and wanted to ask here from those that might know more about it. The the person who has custody during the divorce will more than likely be able to continue to keep custody after the divorce is final. I am the one that is working and has insurance on my son dental and health. She quit her job and walked out on me. I want whats best for my son and don't see how she can do much since she quit her job and moved 300 miles away. Can anyone shed some light on this for me. Thanks and keep us in your prayers

she basically left her son...what is that about? You will definately not have a problem with this situation. How old is he...that is so sad for him, is he doing okay?

Son is 9 and she has taken him against a court order saying that he was to be in my custody. When I did get to talk to him on the phone he was begging me to come get him and bring him home. Right now she has had him for two and a half weeks. When she is only suppose to have him every other weekend. She is refusing to return him stating that he is fine right where he is at. The police are of no help and said that they wouldn't get involved in a civil matter even though I have the court order signed by the judge. Getting to where I have little patience for the police right now where she is at. I miss my son so much and want him to be back home.

do you have a lawyer..or you can contact the district attorney in your area. She really can't do this if he indeed have a temporary court (judge signed) order.

Is she with him all of the time? If not, the police will have no choice but to help you recover your child as long as the other parent isn't there.
Although, with her being 300 miles away, it's going to be hard to do this.
What you need to do is get a court order that orders the return of the child to you. The police will have to enforce that as it is very specific.

From talking to my lawyer that is what we are planning on Monday. She has said that she will not bring him home no matter what the lawyer or judge says. I am afraid of what this is doing to my son now and also later on in his life.

When the order gets signed she will not have a choice. Her lawer may contact her and advice her to bring him back. I went more then a year going through what you are with the police. They never help. After the order was signed things happened in minutes. Actually it took a little more then an hour. Be patient and I'll be praying for ya'll. Be patient.

Thats just it the order has been signed over a week ago. I don't understand this at all and it is bothering me greatly.

You have a court order defining both of you your rights. That's all it does and the police can't do much with that. What your lawer is getting monday is an order for law enforcment to act on those orders. They are two different things. It's easy to get frustrated with the police because it's hard to understand why they need a order dircting them to act. I'm not sure either what the reason is but that is the way it is.
