My husband and I purchased our home in Massachusetts before we got married. It is an unusual property containing rental units in addition to the part we live in. We never legally filed the house with the court as a married couple. Even our mortgage is in my maiden name.
Is is possible to continue to co-own the property after we divorce? Do we have to consider the property as non-marital? My husband is interested in buying me out, but I'm afraid that the real estate market, being what it is, means I will lose my shirt! Furthermore, it was a great investment, and should we choose instead to sell it outright, it would be prudent to wait a couple of years before we do.
