Hello everyone,
I'm from Europe and in love with a married US woman, we met eachother already and we are sure, that we want to marry and life together, i have to say that her husband is treating her very bad (psychological, not physical abuse) but it's hard to get evidence for that, is there a way to get custody for her little daughter (3yr) and life with me in Europe? or is the only way for her to divorce and i life with her in the states? We dont want to lose her little daughter under no circumstances. we are so scared b/c some years ago, she already wanted to divorce, then he said that he will make sure that she wont get custody for her little daughter :( pls pls help us

Your chances of the child moving to Europe are about 0 or less. You have to live in the states, and in the same general area where the child lives now. Custody is about what is best for the child, and not the adults.

hi,
ty for the answer, thats what i expected. and how are the chances for her to lose custody if she files in for divorce? she is fit and can provide a safe stable environment. the only thing we worrie is that she earns not enough money atm to care alone for her daughter, even if she has 2 part time jobs.
what if he would fight for custody? is there a chance for her to lose?

Custody is determined by who is the primary parent while married. That "status quo" usually carries over to divorce. It varies from state to state, but some now promote shared parenting. Beyond that, even if she gets custody, the kids would still not be able to move.
