my boyfriend separated from his wife before we started seeing each other, she told him she filed for divorce pro se then without telling him retained a lawyer and filed on grounds of adultery(when she found out he was seeing me) and named me in the petition! Is it really adultery if he left the home and they both agreed to get a divorce?

that was a short answer, could you elaborate...he and I love each other and we plan to start a life together, so splitting up is not an option...what now?

It's clear from your post you were having an affair before his wife filed for divorce under adultary. Why not just face the music, if it's the truth?

we were not having an affair, she said she wanted a divorce and they split before we started seeing each other...i would not have an affair nor would i be the "other woman". I was really just curious if anyone else had similar situations or if anyone could offer any advice or guidance, i didn't know i would be defending my actions on here....

Yes, it is adultery. In most states, it doesn't make much difference, but I would see an attorney.

I was under the understanding that WV is a no fault state.
