Hi, I was married in Texas, my Wife lives there (and satisfies the residency requirements being "a domiciliary of the State of Texas for at least six months and a resident of a county for ninety days before a divorce can be filed.") however I live overseas. Can I file in the State of Texas? Thanks
Yes. Also consider that your spouse could beat you to it and file a divorce on you at your location if you meet the residency requirements there. Sometimes it can be an advantage to pick one venue or the other depending on how local law treats things (alimony, child support, etc.).
You do have to file in your state of residency, although I'm not too clear on how that works if you're out of the country... How long have you been overseas? If you have been over there for less than 6 months, then obviously it would be no problem. If possible, your wife could file and make it easier on the both of you. Otherwise I would double check with a lawyer beforehand to make sure its allowed, to avoid any problems.
