Hello--- I have been separated from my ex for about 6 months now, and the divorce will soon be finalized....I have been out of work since my daughter was born and have been looking for work, without any luck here....We have a young child together, and I am possibly looking to move out of state to find work. I will be the custodial parent, he has already agreed to that. Are there any laws hindering me from moving from the state as long as I am willing to bring her back here for visitation?? Does he have to agree to this move? Everytime I ask my lawyer this question, he just tip-toes around the issue and never gives me a yes or a no answer, which is really upsetting me!!! I was looking to move to either PA or to NY, but I don't want to put myself in danger of losing all rights to my child if I am doing something that I shouldn't be doing! Any help or direction as to what I am able/not able to do would be a great help!! thanks!!!
Well, it really is going to depend on what the final decree says. You will probably have to get court permission to leave the state. If your ex wants he can try to get custody reverse based on the fact that you are leaving.
